Any person, company or other entity that uses WhatDoctorsThink.com services in any way agrees to the following terms and conditions of use.
CLIENT OBLIGATIONS
You understand that you are completely responsible for all information, data and text that you supply for your survey content, and that the data or information that you provide does not belong exclusively to some other person or entity, and that the data and information you provide is legal to be transmitted and posted publicly by you and by WhatDoctorsThink.com. You also confirm that all the data and text that you provide has no copyright violations, trademark violations, patent violations, trade secret violations, and non-disclosure agreement violations. Additionally, you also confirm that you will not transmit to WhatDoctorsThink.com for posting, any content that is: harmful to anyone, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, hateful, racially or ethnically objectionable, and invasive of any other person's or entity's privacy. You also confirm that by transmitting your content to WhatDoctorsThink.com for posting you are not violating any local, regional, USA or international laws, rules and regulations.
RESTRICTIONS and LIABILITY DISCLAIMERS
WhatDoctorsThink.com reserves the right to refuse to perform any survey at any time at its sole discretion for any reason. WhatDoctorsThink.com also reserves the right at any time with or without notice to not perform or not complete a survey if there have been any violations of the terms of use stated above. If a survey is cancelled or not fully performed then you will receive a partial or complete refund of your payment depending on how much work was completed by WhatDoctorsThink.com, at its sole discretion. You agree that WhatDoctorsThink.com shall not be liable to you or to any third party for any type of direct or indirect damages for any non-performance, suspension or discontinuation of a survey, for whatever reason the survey is not performed or discontinued.
WhatDoctorsThink.com takes appropriate security measures to store your content and survey results. However, you agree that WhatDoctorsThink.com has no responsibility or liability whatsoever, and will not be responsible for any type of direct or indirect damages to you or any third party arising from the deletion of or failure to store any survey data, survey results or other content maintained or transmitted by WhatDoctorsThink.com.
CHARGES and PAYMENT
WhatDoctorsThink.com will provide you with a quote for our survey and market research services which will be based on:
You agree to pay all applicable charges for performance of your survey, by check or credit card, in advance of WhatDoctorsThink.com performing your survey and providing you with the results. If your check or credit card does not clear properly at the time of survey completion, then WhatDoctorsThink.com may decide to not divulge the results of your survey to you.
WhatDoctorsThink.com, at its sole discretion, may choose to add additional charges to any survey, above and beyond the standard pricing, when WhatDoctorsThink.com deems that your survey content or format is intended to capture or collect its database of email addresses by offering an incentive, honorarium, inducement, or by offering a free, or discounted product or service to email recipients of a WhatDoctorsThink.com survey. Additionally, at its sole discretion, WhatDoctorsThink.com may choose to add additional charges to any survey for various other unique reasons that WhatDoctorsThink.com may decide upon. WhatDoctorsThink.com will advise its clients of any additional charges for surveys prior to performing those surveys so that you can decide whether to go ahead with your survey and pay the additional charges.
ENTIRE AGREEMENT
These Terms of Use constitute the entire agreement between WhatDoctorsThink.com and its clients/customers with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Use will be effective only if in writing and signed by WhatDoctorsThink.com's parent company, Telemedical Solutions, Inc.
